Description

This contract is for the safe removal and disposal under license of 3 existing Evans 300/2 Cremators and double emissions abatement system (including all ancillary items connected to the cremation process), replacing them with new, fuel efficient plant and equipment at Wilford Hill Crematorium, Loughborough Road, Nottingham.

The Crematorium must remain operational throughout the programme. The works will therefore require careful planning, phasing, and coordination to ensure continuity of cremation services.

The selected Contractor will enter into a long-term maintenance, servicing, and technical agreement of the cremation plant for up to 25 years, reflecting the anticipated lifecycle of the cremation plant. The maintenance contract will include break clauses at five-year intervals, exercisable at the Authority's discretion.

Justification for not using lots

The Authority has decided not to divide this procurement into lots due to the specialist and interdependent nature of the requirement. The Authority considers that dividing the requirement into separate lots could:

- increase technical and operational risk during decommissioning, installation, and commissioning;

- create interface and accountability risks between multiple supplier;

- undermine clear responsibility for compliance with statutory, environmental, and emissions requirements;

- increase the complexity and cost of contract management over the life of the asset

The Authority therefore considers that a single, integrated contract is the most appropriate means of ensuring safe delivery, continuity of services, clear accountability, and value for money across the full lifecycle of the cremation plant.

Participation

Legal and financial capacity conditions of participation

The contractor will be required to hold the following levels of insurance:

• Employer's Liability: £5,000,000 (where required by law)

• Public Liability: £10,000,000

• Product Liability: £10,000,000 (separate Product Liability policy not required if already included within the provider's Public Liability policy providing it is at the same limit)

• Professional Indemnity : £1,000,000

Tenderers must either confirm they hold these already, or commit to having them in place if awarded the contract.

Technical ability conditions of participation

The Tenderer must demonstrate that it, or any proposed subcontractor undertaking relevant works, holds the following accreditations where applicable:

Current NICEIC or NAPIT registration appropriate to any electrical works being undertaken.

Current Gas Safe registration covering commercial/industrial gas installations relevant to cremation plant.

Current MCERTS accreditation appropriate to any emissions monitoring and/or emissions testing activities being undertaken.

Evidence of the relevant registrations and accreditations must be provided upon request.

Description of risks to contract performance

Local Government Reorganisation: During the anticipated contract period, Nottingham and Nottinghamshire may be subject to Local Government Reorganisation (LGR), a national programme led by central government to restructure two-tier authorities into single unitary councils. This process involves Nottingham City Council, Nottinghamshire County Council, the district/borough councils, and the Ministry of Housing, Communities & Local Government, and may lead to changes in governance, boundaries and service delivery arrangements that could affect this contract. Tenderers should therefore note that organisational and contractual arrangements may need to adapt in line with any LGR implementation.

Changes in statutory, regulatory, environmental or emissions requirements affecting cremation plant and associated abatement systems.

Unforeseen site, structural, utility or integration issues identified during design, installation or commissioning.

Changes required to ensure continued compliance with environmental permits or other regulatory approvals.

Technological developments or manufacturer requirements necessary to maintain the safe and efficient operation of the cremation plant throughout its lifecycle.

The intention is to award the contract at the first time of asking and Tenderers should prepare and submit their Tenders accordingly.

In the event that no tenders are considered satisfactory in all respects and the contract cannot be awarded, the Authority will invite all tenderers which have submitted an otherwise compliant tender to participate in a second stage aimed at improving the content of their tenders. Following the conclusion of this stage tenders will be invited for a second time, and the contract awarded.
